Terms of Use
Welcome to www.trackut.com ("Trackut / Site"). These are the terms and conditions governing
your use of the Site and the general principles applicable for use of
the Site ("Policy"). By accessing Trackut you are agreeing
to the following terms of the Policy, which are designed to make sure
that Trackut works for everyone. This Policy is effective from the time
you log in to Trackut.
Using Trackut
While making use of Trackut
Services (the Services), you will post in the appropriate category or
area and you agree that your use of the Site shall be strictly governed
by the following binding principles:
- "Your Information"
is defined as any information you provide to us or other users of the
Site during the registration or posting in the course of using any other
feature of the Services. You are solely responsible for Your Information,
and we act as a mere platform for your online distribution and publication
of Your Information.
- You certify that
you will not offer to sell, list or display any Mature Audiences Policy
items or items that are restricted to adult use on the Site.
- You shall make use
of the Services and access the Site in compliance with the provisions
of The Information Technology Act, 2000 and any amendments made thereto
from time to time ("IT Act, 2000").
Eligibility
Use of the Site is available only to persons who can form legally binding
contracts under applicable law. Persons who are "incompetent to
contract" within the meaning of the Indian Contract Act, 1872 including
minors, un-discharged insolvents etc. are not eligible to use the Site.
If you are a minor i.e. under the age of 18 years, you cannot register
as a member of the Site and cannot list or use the site in any manner
whatsoever. If Trackut discovers that you are under the age of 18 years,
Trackut reserves the right to terminate your membership and refuse to
provide you with access to the Site. The Site is not available to persons
whose membership has been suspended or terminated by Trackut. If you
are registering as a business entity, you represent that you have the
authority to bind the entity to this Agreement.
Abusing Trackut
Content: The Site contains content which includes Your Information,
Trackut's information and information from other users. You agree not
to copy, modify, or distribute such content (other than Your Information),
Trackut's copyrights or trademarks. When you give us any content as
part of Your Information, you are granting us a non-exclusive, worldwide,
perpetual, irrevocable, royalty-free, sub-licensable right and license
to use, reproduce, modify, adapt, publish, translate, distribute, perform
and display such content (in whole or part) worldwide through the Site.
We need these rights with respect to the content in Your Information
in order to host and display your content.) If you believe that your
rights have been violated, please notify our designated copyright agent
by clicking here and we will investigate the matter. We reserve the
right to remove any such content where we have grounds for suspecting
the violation of these terms and our Listing Policy or of any party's
rights.
Liability
You agree not to hold us responsible
for content / information other users post or do on the Site. As most
of the content/information on Trackut comes from various users, we do
not guarantee the accuracy of postings or user communications or the
quality, safety, or legality of what's offered. We also cannot guarantee
continuous or secure access to our Services. Accordingly, to the extent
legally permitted we exclude all implied warranties, terms and conditions.
We are not liable for any loss of money, goodwill, or reputation, or
any special, indirect, or consequential damages arising out of your
use of Trackut. Some jurisdictions do not allow the disclaimer of warranties
or exclusion of damages, so such disclaimers and exclusions may not
apply to you.
Personal Information
By using Trackut, you agree
to the collection, transfer, storage and use of any personal information
provided by you on the Site by Trackut Limited (the data controller
on servers located in the United States, and in the European Union as
further described in our Privacy Policy).
General
We may update this Policy at
any time, with updates taking effect when you next post or after 30
days, whichever is sooner. If we or our corporate affiliates are involved
in a merger or acquisition, we may share personal information with another
company, but this Policy will continue to apply.
